By downloading, installing, or using Elphi ("the app," "the service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Elphi.
These Terms form a legal agreement between you and Elphi ("we," "our," or "us"), a Maryland limited liability company. By using Elphi, you confirm that you are at least 18 years old, or that you are using the app under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
Elphi is not a medical device. Elphi is a reminder and checklist application designed to help families coordinate routine tasks and safety habits. It is not intended to diagnose, treat, cure, monitor, or prevent any medical condition. It is not a substitute for professional medical care, emergency services, or clinical judgment.
Elphi is designed to support — not replace — human judgment and communication. While Elphi may help remind family members about medications, medical items, or safety routines, you acknowledge that:
Elphi uses Sign in with Apple for account creation and authentication. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your Elphi account.
You agree to provide accurate information when using Elphi and to notify us immediately if you suspect unauthorized access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.
Elphi offers a free tier with limited features as described in the app. No credit card is required for the free tier.
Elphi offers paid subscription plans that unlock additional features. Subscriptions are billed through the Apple App Store on a recurring basis. Current pricing is displayed in the app and on our website at elphiapp.com.
Family and Caregiver plan subscribers are responsible for all activity within their family group. The subscriber who purchases the plan is the account owner and is responsible for billing. Family members added to the group do not require a paid subscription.
You agree to use Elphi only for lawful purposes and in accordance with these Terms. You agree not to:
You retain ownership of any content you enter into Elphi, including checklist names and item names. By using Elphi, you grant us a limited license to store and process your content solely for the purpose of providing the service to you and your family group.
You are solely responsible for the content you enter into Elphi. We strongly recommend against entering sensitive personal information such as Social Security numbers, financial account details, or passwords into any checklist.
Important: Elphi is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that notifications will always be delivered on time or at all.
To the fullest extent permitted by applicable law, Elphi and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to:
Our total liability to you for any claim arising from these Terms or your use of Elphi shall not exceed the amount you paid to us in the twelve months preceding the claim, or $50, whichever is greater.
Your use of Elphi is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Elphi, you consent to the collection and use of information as described in our Privacy Policy.
Elphi, the Elphi logo, the elephant mark, and all related trademarks are the property of Elphi (Serial #99587814, U.S. Patent and Trademark Office). Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without our prior written consent.
All software, design, and content in the app — except for content you create — is owned by or licensed to Elphi and is protected by applicable intellectual property laws.
You may stop using Elphi at any time by deleting the app and requesting account deletion at [email protected].
We reserve the right to suspend or terminate your access to Elphi at any time for violation of these Terms, conduct we determine to be harmful to other users or the service, or for any other reason with reasonable notice. In the event of termination, your right to use the service ceases immediately.
These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of Elphi shall be resolved in the courts of Maryland.
We may update these Terms from time to time as Elphi evolves. When we do, we will update the effective date above and provide notice in the app for material changes. Continued use of Elphi after changes take effect constitutes acceptance of the revised Terms.
